Copyright Laws with cosplay supply making?
I want to make some plush objects to sell online with some of the spare fabric that I have, however I’m not sure how the copyright law comes into effect with doing such and what not. For example, if I made a Kero hat from Card Captor Sakura, or a Paopu fruit from Kingdom Hearts. Should I just write I did not come up with the concept for the item, I just made the product? *Does not want to get sued* ~o~
That depends on which area you live, the server of your website, and the owner of the copyright, which can be in three different area with three different copyright laws.
So as you can see, it’s not very simple.
Not to mention that copyright owners also sometimes can be quite fickle, one moment they might tolerate lots of ‘violations’, but in another they might wish to handle a simple ‘violation’ in a very strict manner.
Copyright owners also might refuse to be offered tributes to compensate for their ‘loss’, but that doesn’t mean the copyright enforcers probably also feel the same thing.
Personally, I think that you should make sample plushies and put their pictures online, but tell people that they are not for sale. But put a note saying that if a person request you to create a plushie, you will be willing to do a customized version for him/her, for a slight material, creation, and shipment fee.
That way at least, you can get someone else to share the blame. Besides, that way also will be like doing fan arts for someone else.
But you definetly should give credit where credit is due, put copyrights and trademarks, tell the people where the concepts came from.
Also, since you’re an individual doing small works, then don’t do mass production, because you will not be able to do it. Mass production require lots of resources, lots of planning, and lots of marketing.
